Originally introduced as the “Prevent Sexual Exploitation of Women and Minors Act” (HB 805) was designed to crack down on the exploitation of children and women in online pornography. It requires pornography websites to verify that every person depicted is at least 18 years old, has given explicit written consent for each sexual act shown, and has provided written consent for that image to be distributed. The bill also provides a clear removal process and enforces meaningful civil penalties when these protections are violated.

Now, the North Carolina Senate has strengthened HB 805 by adding several vital protections for families and parental rights. The updated bill clearly defines sex as male or female based on biology across all North Carolina laws and regulations. It prohibits taxpayer funds from being used for gender-transition surgeries, puberty blockers, or cross-sex hormones for inmates. It also gives individuals harmed by gender-transition procedures a 10-year window to file malpractice suits. For families, HB 805 ensures that parents have the right to opt their child out of classroom materials or activities that conflict with their religious beliefs and requires schools to provide advance notice and alternatives. It makes school library catalogs publicly searchable and allows parents to restrict what their child can check out. And it preserves biological truth in public records by attaching amended birth certificates to the original as a matter of public record.
