NC VALUES APPLAUDS SENATE PASSAGE OF HB 805: A CRITICAL BILL TO PROTECT WOMEN, CHILDREN, VICTIMS OF GENDER IDEOLOGY, AND PARENTAL RIGHTS
The NC Values Coalition today celebrates the passage of HB 805 by the NC Senate along a 27-4 vote. This pro-family legislation reaffirms the biological reality of sex, protects girls in sleeping quarters in K-12 schools, strengthens protections for women and children from exploitation through online pornography, safeguards parental rights in education by giving them a religious opt-out of instruction and transparency and an opt-out for library books, ensures that taxpayer dollars are not used to fund irreversible sex-transition procedures, allows victims of harmful gender transition procedures 10 years to sue for the harm caused, and requires birth certificates to reflect the truth about a person’s sex.
“Today, the NC Senate passed a comprehensive bill that helps families across our state,” said Tami Fitzgerald, Executive Director of the NC Values Coalition. “From protecting women and children from sexual exploitation, to defining male and female by biology in NC law, to protecting girls in private spaces in K-12 schools, to helping victims of harmful gender transition procedures receive justice in court, and allowing parents to have a greater say in their child’s education… the provisions in this bill help make NC a state where families can thrive. We want to thank members of the NC Senate for their support, and members of the NC House for passing the original bills that the omnibus bill combines. The fact that Democrats debated this bill for over an hour but only four of them voted against it demonstrates that they realize their policies are unpopular with the population at large and will cause them to lose elections.”
Key Provisions of HB 805 Include:
- Defining Biological Sex
- The bill creates a legal definition of sex based on biology, not gender identity. This is in line with President Trump’s Executive Order, “Defending Women From Gender Ideology Extremism and Restoring Biological Truth to the Federal Government.”
- Protect NC Girls in Private Spaces
- Prohibit boys and girls in K-12 schools from sharing the same sleeping quarters
- Improving Birth Certificate Integrity
- Any amended birth certificate reflecting a sex change must be issued as a multi-page document that includes the original birth certificate and its biological sex designation.
- Protecting Women and Minors from Sexual Exploitation
- New standards are established for online platforms to verify the age and consent of all individuals appearing in pornographic content. Platforms that fail to comply face steep penalties.
- Restricting State Funds for Sex-Transition Procedures
- Effective July 1, 2025, state funds may not be used—directly or indirectly—for sex-transition surgeries, puberty blockers, or cross-sex hormones for inmates.
- Upholding Parental Rights in Education
- HB 805 ensures parents can opt their children out of instructional materials that conflict with their religious beliefs. It also mandates that school library catalogs be accessible and searchable by parents and students alike and offers parents the right to identify library books that may not be borrowed by their student.
- Protecting Victims of Medical Gender Transition Interventions
- Extends the statute of limitations for suing a doctor for harmful gender transition procedures to 10 years from the date of discovery.
